Agent & Broker Compensation Disclosures

The Consolidated Appropriations Act of 2021 was signed into law on December 27, 2020. This Act contains several mandates to provide greater transparency to health care cost information, including broker compensation.

The disclosure requirements apply to all Retail (Under 65) plans and ERISA Group Plans.

Agent & Broker Action:

• Agent and Broker Action: Starting January 1, 2022, all agents and brokers contracted to sell Individual and Family (U65) and ERISA group plans are required to disclose direct (e.g., commission) and indirect (e.g., bonus contests) compensation information to consumers.
• The total amount of compensation must be disclosed verbally prior to the consumer finalizing plan selection.
